PT. Linimuda Inspirasi Negeri (hereinafter referred to as "Clicky") is a limited liability company incorporated in Indonesia with an address at Jl. Raya Abdullah Safe'i No.1 Tebet Timur, Kec. Tebet, Kota Jakarta Selatan, Special Capital Region of Jakarta 12820. Clicky is a platform that bridges creators to sell products and/or services to users related to events, content and donations.

These terms and conditions govern the use of all services on the Clicky platform and apply to all Users and to any party that submits requests or information to Clicky. By the User registering for a Clicky account, the User is deemed to have read, understood and agreed to the contents of these Terms and Conditions. These Terms and Conditions constitute a binding agreement between the User and Clicky.

In general, the User must be at least 13 (thirteen) years old or married and not under guardianship or conservatorship in order for the User to legally have the capacity and right to bind themselves to these terms and conditions. If the User does not meet these conditions, then the User's actions in registering, accessing, using, or conducting other activities in Clicky services must be under the knowledge, supervision, and legal consent of the User's parents, guardian, or custodian.

A. GENERAL TERMS OF SERVICE Clicky

Clicky manages and provides a platform for creators to sell products to buyers. Clicky acts as an intermediary for creators and buyers to conduct transactions through the Clicky platform, so that the Products offered are not Products made by Clicky.
To be able to conduct transactions through the Clicky platform, Users need to register for a Clicky account. The account registration is free of charge by Clicky.
Users can act as either creators or buyers.
Clicky is unable to pre-screen products uploaded and/or sold by creators on the Clicky platform, so Clicky reserves the right to delete any products uploaded by creators if such products are prohibited or deemed necessary to be deleted by Clicky.
In the event of any conflict and/or discrepancy between Clicky's Terms and Conditions and the terms of service provided by the creator, Clicky's Terms and Conditions shall prevail.
Clicky may at any time change, add to, or reduce these Terms and Conditions while still binding the User. Therefore, Users should review this Terms and Conditions page regularly.
Clicky reserves the right to change, add, update and/or discontinue any service or feature on Clicky at any time with or without prior notice to the User. Such changes will be republished on this page, so Users are requested to revisit this page periodically to see any changes in Clicky's Terms and Conditions.
In the event that Clicky suspects that there has been a violation of the Terms and Conditions, Privacy Policy, or applicable laws and regulations, Clicky may without prior notice take all necessary actions including taking down the product.
If Clicky suspects that a User's account is being used or may be used for unlawful, illegal or fraudulent purposes, Clicky may suspend or close your account; or close any transaction and suspend or close the User's account.

B. TERMS OF SERVICE

1. Accessing the Clicky Platform and Payment Mechanism

To be able to access the Clicky platform, the User must register by filling in the following data:

Nomor

If the User wants to become a creator, the User will be asked to verify their email, and then the User can immediately create an account and sell products after verifying their account. The creator's identity that Clicky stores is limited to email, name, and account number.
Buyers can directly order products sold by creators. When placing an order, the Buyer can make payment through a third party API payment gateway or digital wallet "Payment Method Provider".
After making payment, there will be confirmation via email that the payment has been received and the creator will send the Product to the Buyer.

2. Pricing and Refunds.

The prices of the products contained in Clicky's websites and/or computer programs are the prices set by the creator. Creators are prohibited from manipulating product prices in any way.
The Buyer understands and agrees that any errors in pricing and other information caused by the website and/or Clicky's computer program not being updated due to the browser used by the Buyer is the responsibility of the Buyer.
The Seller understands and agrees that typographical errors that cause errors in pricing and/or other information related to the product are the responsibility of the creator.
Clicky will always do its best to ensure that all details, descriptions, availability and prices of services contained on Clicky's websites and/or computer programs are accurate. However, errors may periodically occur. In the event that Clicky discovers a technical error that is under Clicky's full control that results in a failure to provide the service, Clicky may be able to help facilitate a refund request. Technical errors that may result in a refund include server problems, system outages or similar technical issues caused by Clicky. Refunds will not be processed if the error or problem is caused by an act or omission on the part of the Buyer, such as selecting the wrong service, incorrectly filling in user data, or a wrong email address.
Subscription fees, transaction fees, and other fees that have been sent cannot be exchanged, canceled, refunded, replaced, or transferred to other people/parties.

3. Promo or Discount Codes may be offered to customers at any time. Such codes can only be applied to purchases made through the account where the promo or discount code is offered. Promo or discount codes from one account cannot be transferred to another account.

4. Once a User has registered for a Clicky account, the User is entitled to Access Rights to the services provided by Clicky. The Access Rights that Clicky refers to herein include:

The right to access and view the content, features and services contained in Clicky's website and/or computer program.
The right for the User to manage the User's account, including changing personal information, passwords, or other preferences.
Granting the User the right to terminate the use of the service if desired, as well as determining the consequences or conditions related to the termination of use.

C. LIMITATION OF LIABILITY

Clicky always strives to provide useful services through the Clicky website and/or computer program. However, Clicky understands that Clicky cannot fully guarantee the timeliness, accuracy, suitability, quality, security, and convenience of the clicky website will always be in accordance with the wishes and expectations of the User. Clicky will do its utmost to ensure the security and comfort of Users in using Clicky's website and / or computer program, but Clicky can not guarantee that the Clicky website will always be safe or free from bugs and viruses.
Clicky is a platform with the model Customer to Customer marketplace. Thus, the transaction that occurs is a transaction between the Cilcky User, so the User understands that Clicky is not responsible for any prohibited product sold by Kreator. Furthermore, Clicky will not be liable for any illegal transactions, fraud, manipulation, and counterfeiting committed by the creator on the Clicky platform. All claims, claims or damages may be brought only by the Buyer and/or other third parties to the Creator.
To the extent permitted by applicable legal provisions, Clicky shall not be liable to the User or any other party for any loss or damage in any form whatsoever that may arise as a result of the use of this website, including losses resulting from computer viruses, data loss, use, or other losses, whether tangible or non tangible, whether arising directly or indirectly as a consequence of using this website. If required by law, the User agrees that Clicky's total liability for any claims arising from a breach of these Terms of Service will be limited to the amount that the User pays Clicky to obtain the Rights of Access to the Service of the User's choice.

D. APPLICABLE LAW

The Terms of Use shall be governed by and interpreted in accordance with the laws applicable in Indonesia, without prejudice to the principles of conflict of law. The User agrees that any and all claims that may arise in connection with these Terms of Service "Dispute" or "Conflict" will be sought to be settled peacefully within 60 (sixty) days of the User’s notification to Clicky.
